Terms & Conditions – SHOPIN
Preamble
These Terms and Conditions govern the use of the SHOPIN platform, accessible at shopin.ebuild.website.

1. Purpose and Scope
These Terms and Conditions define the conditions under which SHOPIN connects sellers and buyers of second-hand clothing, shoes, bags and accessories, perfumes and cosmetics, toys, books and stationery, and home items.
Any access or use of the Platform implies unconditional acceptance of these Terms. The Platform reserves the right to modify them at any time; changes take effect upon publication online.
2. Definitions
Platform: website and mobile application connecting sellers and buyers.
Seller: registered user listing items for sale.
Buyer: registered user placing orders.
User: any person accessing the Platform, whether seller or buyer.
Item: any second-hand good listed on the Platform.
Order: purchase of one or more items by a buyer.
Commission: percentage charged by the Platform on each sale.
3. Nature of the Service
3.1 Role of the Platform
SHOPIN acts exclusively as an intermediary between sellers and buyers. It does not sell items itself and never acquires ownership of listed items. It provides the following services: providing a selling space, facilitating connections between users, managing payment collection upon delivery, paying sellers after deducting commission, and coordinating with the carrier.
3.2 Respective Responsibilities
The Seller is solely responsible for the authenticity, quality, condition, and compliance of listed items, the accuracy of all provided information, compliance with applicable law, and the actual availability of items.
The Buyer is responsible for payment upon delivery, receipt of the order, and verifying the conformity of items upon reception.
The Platform does not intervene in item authentication, prior verification of item condition, or resolution of disputes regarding quality or authenticity.
4. Registration & User Account
4.1 Registration Requirements
Using SHOPIN requires creating an account. Registration is open to persons aged at least 18 years, legally capable of entering into contracts, and residing in Morocco.
4.2 Registration Process
During registration, users must provide: full name, valid email address, phone number, home address, and national ID number (CIN). Sellers must also provide bank details (RIB). Users agree to provide accurate and up-to-date information; false information may result in account suspension or deletion.
4.3 Credentials and Security
Users choose a confidential password during registration and are solely responsible for its confidentiality. In case of loss, theft, or fraudulent use, users must immediately notify the Platform.
4.4 Account Suspension and Deletion
The Platform reserves the right to suspend or delete without notice any account in case of: violation of these Terms, fraud or attempted fraud, behavior contrary to public order, non-payment of sums owed, or prolonged inactivity.
5. Listing Items for Sale (Sellers)
5.1 Publishing a Listing
Sellers may list their second-hand items for sale. For each item, they must provide: clear and representative photographs, an accurate and honest description (brand, size, condition, material, any defects), and the desired sale price.
5.2 Seller Obligations
Sellers agree to: only list items they legally own, provide accurate and non-misleading information, not list counterfeit or illicit items, not publish offensive or illegal content, keep items available until sold, package items properly, and hand them over to the carrier within the agreed timeframe.
5.3 Prohibited Items
The following are strictly prohibited: counterfeit or illegally sourced items, weapons, drugs and dangerous products, pornographic or child-exploitative content, items infringing intellectual property rights, and any item whose sale is prohibited under Moroccan law. The Platform reserves the right to remove any non-compliant listing without notice.
5.4 Sale Price
Sellers freely set the price of their items, excluding delivery fees and commission. Once an item is ordered, the price can no longer be modified.
6. Purchasing Items (Buyers)
6.1 Placing an Order
Buyers may order one or more available items. The process is: select item(s) → validate cart → confirm delivery address → confirm order. Order confirmation constitutes acceptance of these Terms and a firm commitment to pay.
6.2 Order Confirmation
A confirmation email is sent summarizing: items ordered, total price (items + delivery fees), delivery address, and order number.
6.3 Item Availability
Items are sold subject to availability. If an item becomes unavailable after ordering, the buyer will be notified and the order will be cancelled at no charge.
7. Pricing & Payment Terms
7.1 Price
The displayed price includes: the seller's price, the commission, and VAT if applicable. The total price is shown in Moroccan dirhams (MAD) and is firm and final.
7.2 Payment Upon Delivery
Payment is made upon delivery, in cash or by any other means accepted by the carrier, directly to the delivery person.
7.3 Payment Distribution
SHOPIN charges a commission on every sale made through the platform, automatically deducted from the amount paid to the seller after delivery confirmation.
— Luxury items (fashion, accessories, branded perfumes): 10% commission
— Other categories (everyday clothing, shoes, toys, books, home items…): 7% commission
Delivery fees are charged to the buyer and are not included in the commission calculation. Sellers receive payment within 36 hours of delivery confirmation.
7.4 Delivery Fees
Delivery fees are charged to the buyer and calculated based on weight, dimensions, and destination. They are clearly displayed before order confirmation.
8. Delivery
8.1 Delivery Terms
Delivery is handled by a third-party carrier appointed by the Platform. The indicative delivery time is 7 business days from order confirmation, subject to the seller handing the item over to the carrier.
8.2 Delivery Tracking
A tracking number is provided to the buyer to follow the progress of their order.
8.3 Receiving the Order
Upon receipt, the buyer must: check the condition of the package in the presence of the delivery person, immediately report any apparent damage, make the payment to the delivery person, and note any damage in writing on the delivery slip.
9. Right of Withdrawal & Returns
9.1 Right of Withdrawal
The buyer has 1 day from receipt of their order to exercise their right of withdrawal, by notifying the Platform via email at morocco.shopin@gmail.com and returning the item in its original, unworn condition with its packaging.
9.2 Items Excluded from Right of Withdrawal
The following are excluded from the right of withdrawal: underwear and intimate hygiene items, swimwear, and personalized items.
9.3 Return Costs
Return shipping costs are borne by the buyer, except in cases of: obvious non-conformity of the item, hidden defects, or a shipping error attributable to the seller.
9.4 Refund
If a return is accepted: if payment has already been made, a refund will be issued within 14 days by bank transfer; if payment has not yet been made, the transaction is cancelled. The refund covers the item price excluding initial delivery fees (unless there is non-conformity or a hidden defect).
10. Warranties & Liability
10.1 Legal Conformity Warranty
The seller is bound by the legal conformity warranty provided by the Moroccan Dahir on Obligations and Contracts. The buyer may request repair, replacement, or refund in the event of a conformity defect.
10.2 Hidden Defects Warranty
The seller is liable for hidden defects that render the item unfit for its intended purpose, or that diminish its use to the extent that the buyer would not have purchased it had they known.
10.3 Limitation of Platform Liability
The Platform, as an intermediary, cannot be held liable for: the authenticity, quality, or safety of listed items, the accuracy of seller listings, disputes between users, or damages resulting from fraudulent use. It does not authenticate luxury or branded items.
10.4 Platform Liability
The Platform is responsible for proper technical functioning, securing personal data, correct execution of collections and payments, and malfunctions directly attributable to it. Its liability is limited to the amount of the transaction in question.
10.5 Force Majeure
The Platform cannot be held liable in cases of force majeure or events beyond its reasonable control (IT failure, cyberattack, natural disaster, strike, etc.).
11. User Obligations
11.1 General Obligations
All users agree to: comply with laws and regulations in force in Morocco, use the Platform in good faith, not infringe on third-party rights, and not post unlawful or offensive content.
11.2 Specific Prohibitions
It is strictly prohibited to: use the Platform for fraudulent purposes, impersonate a third party, post false listings, manipulate prices or reviews, mass-extract Platform data, or disrupt its operation.
11.3 Sanctions
Any breach may result in: removal of unlawful content, temporary or permanent account suspension, legal proceedings, and claims for damages.
12. Intellectual Property
12.1 Platform Rights
All elements of SHOPIN (structure, design, texts, graphics, software, databases, trademarks, logos…) are protected under Moroccan intellectual property law. Any unauthorized reproduction or exploitation is prohibited.
12.2 License of Use
Users are granted a personal, non-exclusive, and non-transferable right to use the Platform, strictly limited to connecting for the purpose of buying/selling items.
12.3 User-Generated Content
By posting content (photos, descriptions, comments), users grant the Platform a non-exclusive, royalty-free, worldwide license to reproduce and distribute this content in the context of operating the Platform. Users guarantee they hold all rights to the content they publish.
13. Personal Data & Privacy
The processing of users' personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using the Platform, users consent to the processing of their data in accordance with Law 09-08 on the protection of personal data.
14. Cookies
SHOPIN uses cookies to improve user experience, analyze traffic, and personalize content. Users may configure their browser to reject cookies, but some features may then not function properly.

The Platform commits to responding within a reasonable timeframe.
15.2 Applicable Law and Jurisdiction
These Terms are governed by Moroccan law, including: the Dahir on Obligations and Contracts (DOC), Law 31-08 on consumer protection, Law 09-08 on personal data, and Law 53-05 on electronic exchange of legal data. If amicable resolution fails, any dispute will be submitted to the competent courts of Casablanca.
16. Miscellaneous Provisions
16.1 Partial Invalidity
If any provision of these Terms is found invalid, the remaining provisions shall retain their full force and effect.
16.2 Entire Agreement
These Terms constitute the entire agreement between SHOPIN and users regarding the use of the Platform.
16.3 Non-Waiver
The Platform's failure to enforce any breach of these Terms shall not be construed as a waiver of its right to enforce such breach in the future.
16.4 Language
These Terms are drafted in French. In the event of translation, only the French version shall prevail.
17. Acceptance of Terms
Use of the Platform implies full and unconditional acceptance of these Terms. Upon account creation, users declare they have read and accept these Terms without reservation by checking the designated box.
Luxury Items – Authentication
SHOPIN offers a dedicated category for luxury and branded items with an enhanced authentication process to ensure trust between buyers and sellers.
Applicable to luxury items priced above 500 MAD
All luxury items listed on SHOPIN are subject to an authenticity check before delivery to the buyer.

Sales process for luxury items:
— The seller lists the item with photos and a detailed description.
— The buyer confirms the order and the item is reserved.
— The item is sent to SHOPIN for authenticity verification.
— Once authenticated, the item is shipped to the buyer.
— Payment is confirmed and the seller is paid within 36 hours.
Luxury items benefit from the same return conditions as standard items, within 1 day of receipt.
Important: SHOPIN does not automatically authenticate all luxury items. Verification is performed upon request or for items exceeding the defined price threshold. SHOPIN disclaims any liability for items not submitted to the authentication process.
