These Terms and Conditions of Use (hereinafter "Terms") govern the use of the platform (hereinafter "the Platform"), accessible at shopin.ebuild.website.
The Platform is published by:
These Terms and Conditions aim to define the conditions under which the Platform connects sellers and buyers of second-hand clothing, shoes, bags and accessories, perfumes and cosmetics, toys, books and supplies, and household items. Any access to and use of the Platform implies unconditional acceptance of these Terms and Conditions. The Platform reserves the right to modify these Terms and Conditions at any time. Changes will take effect upon their online publication.
Platform: website and mobile application connecting sellers and buyers
Seller: registered user offering items for sale
Buyer: registered user ordering items
User: any person accessing the Platform, whether as a seller or buyer
Item: second-hand clothing, shoes, bags and accessories, perfumes and cosmetics, toys, books and supplies, and household items listed for sale on the Platform
Order: purchase of one or more items by a buyer
Commission: percentage collected by the Platform on each sale
The Platform acts exclusively as an intermediary between sellers and buyers. It does not sell items itself and does not at any point acquire ownership of the items listed for sale.
The Platform provides the following services:
Provision of a space allowing sellers to present their items
Facilitation of the connection between sellers and buyers
Management of payment collection upon delivery
Transfer of sale proceeds to the seller, after deduction of the commission
Coordination with the carrier for delivery
The Seller is solely responsible for:
The authenticity, quality, condition and conformity of the items listed for sale
The accuracy of descriptions, photos and information provided
Compliance with applicable legislation (intellectual property, counterfeiting, etc.)
The actual availability of the items
The Buyer is responsible for:
Payment of the price upon delivery
Receipt of the order
Verification of the conformity of items upon receipt
The Platform does not intervene:
In the authentication or certification of items, particularly luxury ones
In the prior verification of the condition of items before listing
In the resolution of disputes relating to the quality or authenticity of items.
Using the Platform requires creating a user account. Registration is reserved for persons who are:
At least 18 years old
Having the legal capacity to enter into contracts
Residing in Morocco
Upon registration, the user must provide the following information:
First and last name
Valid email address
Phone number
Address
National Identity Card number (CIN)
For sellers: bank details (RIB) for payment transfers
The user agrees to provide accurate, complete and up-to-date information. Any incorrect or fraudulent information may result in the suspension or deletion of the account.
The user chooses a confidential password upon registration. They are solely responsible for keeping their credentials safe and confidential. Any use of the account is presumed to originate from its holder.
In case of loss, theft or fraudulent use of their credentials, the user must immediately notify the Platform.
The Platform reserves the right to suspend or delete without notice any account in the event of:
Violation of these Terms and Conditions
Fraud or attempted fraud
Behaviour contrary to public morals or public order
Non-payment of amounts due
Prolonged inactivity
The seller may publish listings to sell their second-hand items. For each item, they must provide:
Clear and representative photographs
An accurate and honest description (brand, size, condition, material, any defects)
The desired selling price
The seller agrees to:
Only offer items they own or have the right to dispose of
Provide accurate and non-misleading information
Not list counterfeit, stolen or unlawfully obtained items
Not publish offensive, discriminatory or unlawful content
Keep their items available until effectively sold
Properly package items for shipment
Hand over items to the carrier within the agreed timeframe
The following are strictly prohibited from sale:
Items that are counterfeit or of unlawful origin
Weapons, drugs, and dangerous products
Content of a pornographic or child pornographic nature
Items infringing intellectual property rights
Any item whose sale is prohibited by Moroccan legislation
The Platform reserves the right to remove any non-compliant listing without prior notice or compensation.
The seller freely sets the selling price of their items. This price excludes delivery charges which will be borne by the buyer and excludes the Platform's commission.
Once an item has been ordered, the price can no longer be modified.
The buyer may order one or more items available on the Platform. The ordering process is as follows:
1. Selection of the item(s)
2. Cart validation
3. Delivery address confirmation
4. Order validation
Validating the order constitutes acceptance of these Terms and Conditions and a firm commitment to payment.
An order confirmation is sent by email to the buyer summarising:
The ordered items
The total price (item price + delivery charges)
The delivery address
The order number
Items are sold subject to availability. If an item becomes unavailable after an order has been placed, the buyer will be notified and the order will be cancelled free of charge.
The displayed price for each item includes:
The price set by the seller
The Commission
VAT where applicable
The total price is indicated in Moroccan dirhams (MAD) and is firm and final.
Payment is made upon delivery, in cash or by any other means accepted by the carrier, directly to the delivery person.
SHOPIN charges a commission on every sale made through the platform, automatically deducted from the amount paid to the seller after delivery confirmation.
— Luxury items (fashion, accessories, branded perfumes): 10% commission
— Other categories (everyday clothing, shoes, toys, books, home items…): 7% commission
Delivery fees are charged to the buyer and are not included in the commission calculation. Sellers receive payment within 36 hours of delivery confirmation.
Delivery charges are borne by the buyer and calculated based on weight, dimensions and destination. They are clearly indicated before order validation.
Delivery is handled by a third-party carrier appointed by the Platform.
The indicative delivery time is 7 working days from order confirmation, subject to the seller effectively handing over the item to the carrier.
A tracking number is provided to the buyer allowing them to follow the progress of their order.
Upon receipt, the buyer must:
Check the condition of the parcel in the presence of the delivery person
Immediately report any apparent anomaly (damaged, open parcel, etc.)
Make the payment to the delivery person
Issue written reservations on the delivery note in case of damage
The buyer has 1 day from receipt of their order to exercise their right of withdrawal.
The following are excluded from the right of withdrawal:
Underwear and intimate hygiene items
Swimwear
Personalised items
Return charges are borne by the buyer, except in cases of:
Manifest non-conformity of the item
Hidden defect
Dispatch error attributable to the seller
In the event of an accepted return:
If payment has already been made: refund within 14 days by bank transfer
If payment has not yet been made: cancellation of the transaction
The refund covers the price of the item excluding initial delivery charges (except in cases of non-conformity or hidden defect).
The seller is bound by the legal warranty of conformity provided for by the Moroccan Dahir of Obligations and Contracts. The buyer may demand repair, replacement or refund in the event of a lack of conformity.
The seller is liable for hidden defects rendering the item unfit for its intended use or so diminishing such use that the buyer would not have purchased it had they been aware of them.
The Platform, in its capacity as intermediary, cannot be held liable for:
The authenticity, quality or safety of items listed for sale
The truthfulness or accuracy of listings published by sellers
Disputes between sellers and buyers relating to transactions
Damages resulting from fraudulent use of the Platform by a user
The Platform does not guarantee and does not authenticate luxury or branded items. It carries out no verification of the authenticity of products.
The Platform is responsible for:
The proper technical functioning of the Platform
The security of personal data in accordance with regulations
The proper execution of payment collection and disbursement
Malfunctions directly attributable to it
The Platform's liability may only be engaged in the event of proven fault and is limited to the amount of the transaction concerned.
The Platform cannot be held liable in the event of force majeure or events beyond its reasonable control (computer failure, cyberattack, natural disaster, act of authority, strike, etc.).
Every user agrees to: comply with the laws and regulations in force in Morocco, use the Platform in a fair and appropriate manner, not infringe on the rights of third parties, and not distribute any unlawful, offensive or immoral content.
It is strictly prohibited to: use the Platform for fraudulent purposes, impersonate a third party, post false listings, manipulate prices or reviews, mass-extract or copy data from the Platform, or disrupt its operation.
Any breach of the above obligations may result in: removal of unlawful content, temporary or permanent suspension of the account, legal proceedings, and claims for damages.
All elements of SHOPIN (structure, design, texts, graphics, software, databases, trademarks, logos…) are protected by Moroccan intellectual property law. Any unauthorised reproduction, representation, modification or exploitation is prohibited and constitutes an infringement punishable under Moroccan law.
The user is granted a personal, non-exclusive and non-transferable right to use the Platform, strictly limited to connecting buyers and sellers of items.
By publishing content on the Platform (photos, descriptions, comments), the user grants the Platform a non-exclusive, royalty-free, worldwide licence for the duration of copyright protection, to reproduce, represent and distribute such content in the context of operating the Platform. The user warrants that they hold all rights over the content they publish and that it does not infringe on the rights of third parties.
The processing of users' personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using the Platform, the user accepts the processing of their personal data in accordance with the Privacy Policy and Law 09-08 relating to the protection of personal data.
SHOPIN uses cookies to improve the user experience, analyse traffic and personalise content. The user may configure their browser to refuse cookies, but certain features of the Platform may then no longer function correctly.

The Platform undertakes to respond within a reasonable timeframe.
These Terms are governed by Moroccan law, including: the Dahir of Obligations and Contracts (DOC), Law 31-08 on consumer protection measures, Law 09-08 on the protection of personal data, and Law 53-05 on the electronic exchange of legal data. If amicable resolution fails, any dispute shall be submitted to the competent courts of Casablanca, Morocco.
If one or more provisions of these Terms are held to be invalid or declared as such pursuant to a law or a court decision, the remaining provisions shall retain their full force and effect.
These Terms constitute the entire agreement between SHOPIN and users regarding the use of the Platform.
The Platform's failure to enforce any breach by a user of any obligation under these Terms shall not be construed as a waiver of the right to enforce such breach at a later date.
These Terms are written in French. In the event of a translation, only the French version shall prevail.
Use of the Platform implies full and unreserved acceptance of these Terms. Upon creating an account, the user declares that they have read and accept these Terms without reservation by ticking the box provided for this purpose.
SHOPIN offers a dedicated category for luxury and branded items with an enhanced authentication process to ensure trust between buyers and sellers.
Applicable to luxury items priced above 500 MAD
All luxury items listed on SHOPIN are subject to an authenticity check before delivery to the buyer.

Sales process for luxury items:
— The seller lists the item with photos and a detailed description.
— The buyer confirms the order and the item is reserved.
— The item is sent to SHOPIN for authenticity verification.
— Once authenticated, the item is shipped to the buyer.
— Payment is confirmed and the seller is paid within 36 hours.
Luxury items benefit from the same return conditions as standard items, within 1 day of receipt.
Important: SHOPIN does not automatically authenticate all luxury items. Verification is performed upon request or for items exceeding the defined price threshold. SHOPIN disclaims any liability for items not submitted to the authentication process.
Our platform allows users to create and publish product listings. By using this feature, you agree not to post or share content that:
— Is false, misleading, or fraudulent
— Is abusive, offensive, hateful, or discriminatory
— Contains illegal items or promotes illegal activities
— Contains inappropriate or explicit content
— Violates the rights of others
We have a zero-tolerance policy for objectionable content and abusive users.
— All listings may be reviewed before or after publication
— We reserve the right to remove any listing at our discretion
— We may suspend or permanently ban users who violate these rules
— Users can report listings or sellers that violate these rules
— Users can block sellers, which will prevent their listings from appearing again
— All reports are reviewed by our moderation team
We review and take action on reported content within 24 hours, including removing listings and suspending users when necessary.
